SPICY NOTES: Penepian Penamatan Kerja Tidak Sah (unfair dismissal) & Timeline to File Case (Sec 20 IRA 1967)
🕒 Timeline: "60 Days Only, No Drag-Drag!"
Kalau kena buang kerja secara tak adil (unjust/unfair dismissal) – e.g. buang tanpa siasatan, suka-suka je buang – pekerja wajib file representasi dalam masa 60 hari dari tarikh penamatan (don't pm me on how to calculate the 60 days ya - use your GOD given brain please ya)
Kalau lebih dari 60 hari, JPP boleh reject terus. Kalau nak mintak pertimbangan khas, better ada reason yang sangat kuat (sakit tenat, trauma, etc.).

Seksyen 20(1), Akta Perhubungan Perusahaan 1967 (IRA 1967)
"Seorang pekerja yang dibuang kerja tanpa sebab adil dan saksama boleh buat representasi kepada Ketua Pengarah Perhubungan Perusahaan dalam 60 hari."
Famous Landmark Cases Malaysia – Jangan Main-Main
1. Goon Kwee Phoy v J&P Coats (M) Bhd [1981] 2 MLJ 129
Principle: Majikan tak boleh simply buang pekerja walau ada kontrak. Kalau dismissal tak ikut prosedur betul – boleh jadi dismissal tu tak sah.
🔥 Quote style: "Kalau alasan termination tak disokong bukti kukuh atau siasatan fair, court boleh panggil balik pekerja."
2. Hong Leong Equipment Sdn Bhd v Liew Fook Chuan [1996] 1 MLJ 481
Principle: "Substantive and procedural fairness" dua-dua kena ada. Tak cukup kalau alasan buang tu betul – cara buang pun mesti ikut SOP.
🔥 Quote style: “Even kalau pekerja salah, kalau cara buang tak ikut due process – still boleh kena declare tak sah.”
3. Dreamland Corp (M) Sdn Bhd v Choong Chin Sooi & Anor [1988] 1 MLJ 111
Principle: Kalau ada misconduct pun, domestic inquiry (DI) kena dijalankan dulu – unless pekerja mengaku salah or bukti sangat terang-terang.
⚠️ Reminder:
No DI = Not necessarily fatal, tapi kalau tak buat, majikan kena prove yang mereka fair & just dalam buat keputusan.
Burden of proof always on majikan. Pekerja hanya perlu prima facie proof that dismissal berlaku.

Kalau pekerja nak fight termination:
Simpan semua dokumen penting: surat lantikan, surat tunjuk sebab, surat termination, email, WhatsApp (kalau official).
Dapatkan bantuan Kesatuan Sekerja (jika ahli), atau terus rujuk JPP negeri.
Legal rep optional, tapi boleh bantu masa peringkat Industrial Court nanti (boleh pergi ke MTUC, biro bantuan guaman atau any lawyers yang you suka-bayaran tertakluk pada charge counsel masing-masing ya)
